The shoulder is a complex part of our anatomy and is the joint most likely to become dislocated mainly due to its construction which gives it a greater range of movement than any other joint. It is a ball and socket joint whose stability depends on it being held in place by tendons, muscles and ligaments. It consists of three bones, the scapula (shoulder blade), the clavicle (collarbone) and the humerus (upper arm bone). Whilst a shoulder injury can occur spontaneously without any obvious outside contributing factors there are many injuries that are caused as a result of an accident which may be due to negligence by a third party. If you have suffered a shoulder injury in an accident for which you were not entirely to blame, you should consult a solicitor for advice on starting a shoulder injury compensation claim. There are time limits and you must settle your claim or at least issue proceedings in a court of law within three years of the incident that caused the injury.
Third Party Negligence?
Most dislocations and fractures occur whilst playing contact sports such as football and rugby or as a result of a motor vehicle accident or in an accident at work. If you think your shoulder injury is due to the negligence of a third party you are entitled to claim damages in a shoulder injury compensation claim :-
Sports
Sports venues and players at almost every level should be covered by insurance. Whilst most shoulder injuries in sporting activity occur in contact sports there are numerous similar injuries caused by non contact, overhead sports such as swimming, weight training and tennis which do not give grounds for taking legal action for sports injury compensation except in cases where supervision and instruction by a trainer are inadequate. If you are injured as a result of a dangerous challenge, faulty equipment or playing surface you may be entitled to start a shoulder injury compensation claim.
Road Traffic Accident
If you have injured your shoulder in a road traffic accident, the insurance company of the driver who is found to be at fault has to pay you compensation. If the driver was not insured or it was a ‘hit & run’ accident the Motor Insurers Bureau will pay your shoulder injury claim.
Accident at Work
If you injure your shoulder in an accident at work and can prove that your employer was negligent, you will be entitled to start a shoulder injury compensation claim. Failure by an employer to provide a safe system of work and a safe working environment together with adequate training and supervision will give grounds for an industrial accident claim for shoulder injury compensation.
